Egyptian Women’s Rights After Divorce In The Law

Women’s rights after divorce, legally

 

Women have the right to certain benefits after divorce in law.
Legally, the divorced woman is entitled to the deferred dowry written in the marriage contract, the maintenance of the waiting period, its maintenance, the net, and the list of movables.
In addition, a woman who was a guardian at the time of her marriage is entitled to an apartment after her divorce.

In terms of the law, Article 2 of the Egyptian Personal Status Law of 2019 states that eligible divorcees have the right to sufficiency.

Women in Egypt also enjoy certain rights that are institutionalized or supported by their governments. Moreover, childless wives are not without rights; They are still entitled to some dues such as delaying the dowry and waiting period expenses.

Women’s rights after divorce in Islam

Women’s rights after divorce in Islam are divided into two categories:
material and moral rights. On the material level, Islam has granted the maintenance of the waiting period, the maintenance of pleasure, the net, the list of movables, and the back of dowry for divorced women.

She also has the right to alimony, clothing, and housing while awaiting a revocable divorce. Furthermore, a woman can be entitled to payment for breastfeeding her child after the waiting period is over.

Finally, Islam also grants them a deferred dowry if it remains in the hands of the husband and its term has expired.
On the moral level, Islam grants women respect and dignity by recognizing their rights before and after divorce.

This view applies to other monotheistic religions that elevate the status of women. Women’s rights are an important aspect of preserving them after divorce in Islam.

The rights of the wife after the divorce with children in Egypt

The rights of a wife after the divorce of children in Egypt are wide and varied and are stipulated in existing laws.
The wife is entitled to several alimonies, estimated at three months of monthly alimony, as well as alimony for pleasure ranging from two to five years.

She is also entitled to a delayed dowry written in the marriage contract, maintenance for the waiting period, and maintenance for pleasure.
Divorced women with children are also entitled to apply for housing rent and claim alimony after entering into their marriage.

Other rights include the right to run investigations to investigate the husband’s property as well as the right to receive the value of the deferred amount that was recorded in the marriage contract.

Alimony for the wife after divorce in Egypt

In Egypt, the wife’s alimony after the divorce is estimated according to the husband’s condition at the time it is due. The Personal Status Law may determine the amount of alimony for the wife after divorce.

The estimated amount of pleasure depends on the number of years the couple has been married. If the spouses have been together for ten consecutive years or more, the amount of money for pleasure at the expense of five years is estimated at a minimum of 2,000 pounds.

For couples who have been married for 15 consecutive years or more, the amount of pleasure is estimated at seven years at a minimum of 2,500 pounds.
In addition, the wife’s alimony is calculated based on her husband’s income.

If he is an employee in the public or private sector, his income items that are obtained from his job are taken into account when determining alimony.
The wife is also entitled to take half of the dowry fixed in her marriage contract or with witnesses.

Housing is the wife’s right after divorce

According to Islamic law, a divorced woman has the right to obtain housing after a divorce. This was explained in Surat Al-Talaq, which stipulates that the divorced woman must have a safe home.
In some cases, if the husband lives in the house of the wife’s parents, his place of residence must be taken into account as well.

The wife may also have the right to the furniture and luggage if the spouses agree on the movable matrimonial list.

In addition, if the divorced woman does not have any source of income or lacks the necessary funds to provide adequate housing, she has the right to own the marital home to ensure a decent life suitable for her and her children.
It is important to note that the husband is not obligated to support her after the divorce.

The rights of a non-custodial wife after divorce

A non-custodial wife after divorce in Egypt has several rights as set out in the law. Including the expiry of the dowry established in the marriage contract, or by the testimony of witnesses, as well as the expense of pleasure, which is estimated at twenty-four months at least from the monthly alimony.
The list of movables is based on factual data that shows what the wife owns and owes before and after the divorce.

The rights of the wife after divorce by mutual consent

When the spouse divorce by mutual consent, the wife is legally entitled to compensation by the rights stipulated in Islamic law.
This includes the right to receive the full delay dowry, in addition to the expenses of pleasure and waiting period.
The law also affirmed the wife’s right to obtain all her furniture that she purchased or it’s equivalent.

The woman is also entitled to the deferred amount recorded in the marriage document. Moreover, if a divorce contract is concluded, the wife is entitled to a monthly allowance for child maintenance and other rights depending on the divorce status and method of divorce.

It is important to note that if there is an agreement between the spouses, they do not have to resort to court proceedings.
